I agree about Dean Annands statement, it was great. Unfortunately I really am unsure if it actually connected to the ethic's part of the presentation for many people. Rather than focusing on these topics directly the talk skirted around using "professionalism" as a code for "non-rasistc/sexist/ignorant douchebag." Unfortunately these two are not synonymous. That is, I could follow most, if not all of her guidelines and still be an ignorant jerk. It was disappointing for me, although I am glad they tried. Sometime I think they just have to be more direct and address these problems head on. (ie: "There was sexist/raacist behavior at the first year banquet/ in class and the law school does not support this. We think at this stage in your schooling you ought to know better. It is a shame." That is all that would have needed to be said to clear the air. Sigh)... Hugs.

I agree with you, Stephanie. I think I tried pointing that out last year, too, and was also shut down about it. It makes me wonder if in some instances the blinders are on and in order to maintain a facade of gender equality, we sometimes are told there are no differences. I try to say that being different is not the same as being unequal - it just means different. But I still don't seem to be heard, sometimes. Maybe it's because I am a woman and can easily fade into the background! :P

This was my first week of grad school, and I find your assessment of gender in negotiation surprisingly relevant to my situation. I'm in humanities, not law, but working in a group composed entirely of women, in a class composed entirely woman, overseen by a female instructor has not been the collaborative experience I expected. Many of my classmates seem to be intentionally fading into the background, while at the same time expressing resentment of position. WTF?!?! Obviously, I'm generalizing and haven't known these women long enough to have any real idea of where they're coming from. But c'mon now! Next week will be better....

Wow, Stephanie. I am not a lawyer nor a professor, let alone a law professor, but I have been in a lot of negotiations and I agree with your thesis. I think two things are wrath added consideration.

When a negotiator of either gender begins with the behaviour of the other gender, it causes great confusion among the participants. When the woman is choosing the "male" approach, it usually produces the reactions you described above.

Secondly, when a person who has taken the low aggression approach does not give up their interests and pushes back in argument, the aggressors become very confused and frequently fall back on bluster rather than counter argument. Over a long negotiation, this leaves the aggressive participant with severely constrained options.

These observations may not hold up invariably, but they have often worked for me.

LOL! I feel your pain. We had five days of dayhome Christmas, followed by five days of family Christmas, followed by a whole lot of couching and slack. I then drank wine and cleaned my office, because I'm cool like that. Tomorrow, I fully intend to attack my husband's filing and start working on my year-end taxes three months early. School starts for me on January 9th....
Best of luck with your letter-writing campaign ;)
